On the occasion of its last meeting held on 27 August 2009, the Dispute Resolution Chamber (DRC) was called to pass a decision in a contractual dispute opposing the French club Lens to the French player Gael Kakuta and the English club Chelsea.

The French club had lodged a claim with FIFA seeking compensation for breach of contract from the player and requesting also sporting sanctions to be imposed on the player and the English club for breach of contract and inducement to breach of contract respectively.

The DRC found that the player had indeed breached a contract signed with the French club. Equally, the DRC deemed it to be established that the English club induced the player to such a breach.

As a result the player was condemned to pay compensation in the amount of €780,000, for which the club, Chelsea, are jointly and severally liable, and sporting sanctions were imposed on both the player and Chelsea in accordance with art. 17 par. 3 and 4 of the Regulations on the Status and Transfer of Players.

A restriction of four months on his eligibility to play in official matches has been imposed on Kakuta. Chelsea are banned from registering any new players, either nationally or internationally, for the two next entire and consecutive registration periods following the notification of the present decision.

Furthermore, the club, Chelsea, have to pay Lens training compensation in the amount of €130,000.

it is on sky now aswell.

no Pato, Ribery or Aguero then

Jens' Face - September 3, 2009 01:03 PM (GMT)

that's what it sounds like, but it's very very hard to believe. Is it true that "the two next entire and consecutive registration periods" = Jan transfer window and the summer transfer window?

That is, the chavs won't be able to sign a new player until the Jan transfer window 2011?

I want to celebrate, but I really can't believe it.

Maxzimus - September 3, 2009 01:08 PM (GMT)
We had better watch out with our poaching of kids......oh wait we don't sign anyone anyway so no need to worry! :run:

Der_Kaiser - September 3, 2009 01:09 PM (GMT)
We were tentatively linked to signing Kakuta from them last year, I think.

I guess Ancelotti won't be able to fully make his mark on the side until 2011.

And if things go wrong (severe injury crisis or Ancelotti is sacked), they (or new manager assuming the latter happens) won't be able to fix it with a signing.

Maybe some of the decent youngsters they have might actually get a chance to play in the first team.

-------

Can they appeal the decision?

Grebbo - September 3, 2009 01:11 PM (GMT)
There is not a chance that they will be banned from two transfer windows.

Absolutely no chance.

There must be some kind of appeal process?

McNamara That Ghost... - September 3, 2009 01:14 PM (GMT)
I'd laugh heartily but they probably won't need too many changes to their squad anyway. Still, it means they can't compensate for the loss of their African players this winter.

Also, how long was the suspended sentence over the Ashley Cole thing for? I imagine it would have been two years which is annoying but I don't know for certain.

(I'm sure they will appeal, and probably get it reduced to one transfer window or something. But this punishment is not unique; other clubs have suffered it; there's precedent.)

Complete and utter bollocks.

Corrupt c**ts, the lot of them. This is footballing injustice of the highest order. FIFA should be ashamed of themselves.

Where the f**k is Ferguson's ban then? This is a f**king disgrace.

Whatever - September 3, 2009 01:31 PM (GMT)

Amusing, but certain to be overturned or at least reduced on appeal.

we don't know that, 'cause we don't know what the Chavs did.

(I mean we don't know "insane." It's self-evident that it's good. No disagreement with you there.)

I love how one of them whines they should have been fined.
Yeah, cos when daddy's paying it doesn't really matter if you're fined does it?

I just cant imagine how much they would have tried to convince the frenchie to break his contract with another club. Thus i dont know how proportionate this sanction will be to their actions.

i.e. im guessing it's insane and wont stand up on appeal.

Grebbo - September 3, 2009 01:47 PM (GMT)
Maybe Chelsea will break even by 2010 after all!

That's a good point. Anyone nearing the end of their contract can now demand a huge salary increase as they know the club can't replace them.

Couldnt happen to a more deserving club

I just saw this post by a Citeh fan on a Spurs forum. Now I don't normally pay much attention because lots of fans on forums post shit. However, I just couldn't get my head around it:

QUOTE
Good news for City and Spurs.

Liverpool are in financial trouble, while United and Arsenal are on the cusp of having to sell prized assets.

Now Chelsea, with four of their top five players (Lapmpard, Terry, Carvahlo and Drogba) are 30ish years old, will be unable to sign players until 2011. When they do return to the transfer market, it will be in January, a time when few decent players are available.

The rest of his post was reasonable. But how on earth did he come to that conclusion??

It's so frustrating in that they could apply penalties that hurt to real things that need sorting out but they focus on crap like people taking their shirts off rather than things that are actually important like breaking legs and diving*.

* yes - but on a regular basis with all teams being kicked in the arse when their players dive
